Terms of Service

1. Acceptance

By creating an account or using the Service, you confirm that you are at least 18 years old or have obtained parental consent, and that you have the authority to enter into these Terms. If you are using the Service on behalf of a school or organisation, you represent that you have authority to bind that entity.

2. Service description

French Fun Games is a curated collection of educational games for early French immersion students. Teachers can create accounts, manage a classroom of up to 25 students, select which games are visible to each student, and track activity. Students access games via an avatar and PIN without needing a personal email address.

3. Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use. You must provide accurate information and keep it updated.

4. Prohibited conduct

You must not misuse the Service. This includes, but is not limited to:

• Using the Service for any unlawful purpose.
• Engaging in fraud, spam, or deceptive practices.
• Infringing intellectual property rights of others.
• Interfering with the security of the Service (e.g., malware, probing, scraping).
• Attempting to circumvent technical limitations or access restrictions.
• Reverse engineering, decompiling, or disassembling any part of the Service.

5. Intellectual property

DeSmedt Games retains all ownership rights in the Service, including software, documentation, branding, and content. We grant you a limited, non-exclusive, non-transferable right to use the Service within the scope of your selected plan. You may not resell, redistribute, or sublicense access to the Service.

6. Payment, billing, and subscriptions

Teacher Pro subscriptions are billed annually. Payment, billing, tax, and subscription management are handled by our online reseller and Merchant of Record, Paddle. For details on payment terms, renewals, cancellations, and refunds, please refer to Paddle's Buyer Terms.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Service level

We aim to provide a reliable and available service, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service is provided "as is" without warranties of any kind, either express or implied, to the fullest extent permitted by law.

8. Limitation of liability

To the extent permitted by law, DeSmedt Games' aggregate liability shall be limited to the fees paid by you in the 12 months preceding the claim. We shall not be liable for any indirect, consequential, or special damages, including loss of profits, data, or goodwill, except where prohibited by law.

9. Indemnity

You agree to indemnify and hold harmless DeSmedt Games from any claims arising from your use of the Service, your content, or your violation of these Terms.

10. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will continue to apply.

11. Changes to terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be notified via email or through the Service.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which DeSmedt Games operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
